Maqasid Syariah Perspektif Ibnu ‘Ashur: Kajian Kritis dan Kontekstual

Abstract

This study examines Ibn Ashur's thoughts on Maqasid Sharia with a critical and contextual approach. Ibn Ashur is known as one of the reformers who made a significant contribution to developing the concept of Maqasid Sharia, making it relevant to the needs of society in various eras. This study aims to explore how Ibn Ashur understood Maqasid Sharia as a universal principle that emphasizes benefit (al-maslahahh) and justice (al-adl) in Islamic law.  The research method used is a literature review with a descriptive-critical analysis of Ibn Ashur's works, especially the book "Maqasid al-Shariah al-Islamiyyah". In addition, this study also compares his thinking with classical and contemporary figures to highlight the relevance of the concept of Maqasid Syariah in answering modern challenges, such as social justice, environmental sustainability, and human rights.  The results of the study show that Ibn Asur offers a progressive paradigm in understanding Sharia, which is not only focused on the formal aspects of the law, but also on its essence and main purpose. This approach provides a foundation for a more inclusive and responsive reconstruction of Islamic law to the dynamics of the times. This study concludes that Ibn Ashur's thought on Maqasid Sharia has great potential to become a framework for solutions to various social and global problems today, without leaving the traditional roots of Sharia.
